Britney Spears is being sued for more than 10 million dollars by a licensing firm that helped the pop star launch a fragrance line marketed by Elizabeth Arden Inc.
Brand Sense Partners has filed a breach of contract lawsuit against the Femme Fatale singer, also naming her father, Jamie Spears, who is the conservator of her estate. The company claims that the Spears camp went behind their back in a "sneaky, under-handed effort" to cheat them out of a cut of the profits from Britney's Elizabeth Arden fragrance deal.
According to the complaint, Spears hooked up with Brand Sense Partners in 2003 to look for possible licensing opportunities. The following year, the company brokered a celebrity fragrance deal for the singer with Elizabeth Arden, in exchange for a 35 percent commission from "any and all products" Britney worked on with the cosmetics company.
Britney Spears proceeded to roll out a lucrative line of signed fragrance products in partnership with the Elizabeth Arden brand, including the perfumes "Radiance," "Midnight Fantasy" and "Curious."
The suit further alleges that Britney secretly contacted Elizabeth Arden in 2010, instructing them to send all fragrance royalties straight to her. Later, when "caught red-handed," Jamie Spears acknowledged the 35 percent deal, but then proceeded to complain "that the commission was too high and said that Britney did not want to pay it."
We guess they're holding it against her. Brand Sense Partners says it has received its proper share of profits up to February 2011, when Britney negotiated a direct licensing deal with Elizabeth Arden. But, the plaintiff insists, its deal with the Spears is still in effect, the new Arden deal is a "fraud" and Brand Sense Partners has been robbed of at least 10 million dollars in "consequential and incidental" damages. The licensing company wants its 35 percent cut as long as Elizabeth Arden is making scents with Britney.
In addition, Brand Sense Partners is seeking punitive damages "based on the wanton, willful and oppressive nature" of the Spears' conduct.
Britney's team has not yet commented publicly on the lawsuit.
